This session delivered by Rachel McCastman and Mark Abbott from Bates Wells, facilitated by NUS Charity will cover the following topics:
• Charity law basics, duties and the Charity Commission/OSCR
• The NUS model constitutions
• Legal forms / incorporation
• The bigger picture: campaigning/political activity, elections, trading, safeguarding

By the end of this session, you should be able to:
• Articulate the fundamentals of charity law, including the legal obligations and responsibilities that charitable organisations must adhere to.
• Identify the roles and functions of regulatory bodies such as the Charity Commission and OSCR (Office of the Scottish Charity Regulator) and their impact on charitable organisations.
• Understand how to access the NUS model constitutions resources, including their structure, purpose, and implications for student organisations.
• Discuss the various legal forms and incorporation options available to charitable organisations, enabling informed decision-making regarding the legal structure that best suits your objectives.
• Understand the broader context of charitable activities, including engaging in campaigning and political activities, navigating election processes, understanding the implications of trading, and implementing effective safeguarding measures.
